Comprehensive Understanding of The Employment Act and Its Practical Applications 

 

The Ministry of Manpower (MOM) has announced changes to the Employment Act (EA) which will ensure better protection for PMEs while allowing flexibility for employers. The MOM will be introducing the EA amendment bill in Parliament in the second half of 2013. When passed in Parliament, the changes will come into force in the first half of 2014.

 

Therefore, can employers simply adopt contractual simplicitor for PMEs? Give bogus managerial or executive designations to non-executive to circumvent EA?

 

What are the necessary preparations in view of the proposed EA changes?

1. Differences between statutory law employee and common law employee (Professionals, Managers and Executives).

2. Comprehensive understanding of the Employment Act which is a must know for all HR practitioners.

3. Entitlement under Children Development Co-Savings Act which must be read with the Employment Act.

4. Application of Employment Act to day-to-day dealings at the workplace, and in particular to HR policies and procedures, employment contracts, Collective Agreement etc.

5. Amendments to the Employment Act to be effective 2014

About the Trainer:-

 

Arthur Khong is Principal Consultant of HR Law Academy, a HR training and consultancy services company specialising in employment laws and industrial relations. 

 

Arthur first began his career with the Singapore Police Force and embarked on his HR management career with Western Digital in 1993.  He has since held several senior HR positions - General Manager - HR of Keppel Energy, Group Regional Vice President - HR of Yeo Hiap Seng, Director of HR (Hotels) of Far East Organization and Director of HR of Goodwood Park Hotel.  In his 20 years' career span in HR, Arthur has also held regional HR responsibilities for Brazil, China, Ecuador, Hong Kong, Malaysia, UK and USA.

 

Arthur possesses a Bachelor of Arts (Applied Economics), a Bachelor of Laws (Hons) and a Master's in HR Management.  He is currently an adjunct faculty member of SIM University where he lectures Employment Laws, Employee and Industrial Relations and HR Management.

 

Arthur is Asst Honorary Treasurer and Chairman of the Employment Laws and Industrial Relations Committee of SHRI, Non-Practitioner Member of Law Society of Singapore and Fellow Member of Singapore Institute of Arbitrators.  He is also a former Industrial Relations Panel Member and Chairman (Other Areas) of SNEF.
